The Houston County Board of Commissioners met in regular session at 9:00 a.m. on Tuesday, July 3, 2012 at the Houston County Courthouse in Perry, Georgia with Chairman Stalnaker presiding and Commissioners McMichael, Walker, Thomson and Robinson present.  Also present were Director of Administration Barry Holland, Director of Operations Robbie Dunbar, HEMA/Fire Chief Jimmy Williams, Director of Personnel Ken Carter, Chief Building Inspector Tim Andrews, District Attorney George Hartwig, Assistant District Attorney Jacob Poole, Public Defender Nick White, Perry Chamber President Stacey Campbell, Chris Murman of Houston Country Club, Walton and Becky Wood and County Attorney Tom Hall. 

 

Commissioner Walker led the audience in the Invocation.  

 

Chairman Stalnaker introduced Mr. Levi Rozier, retired Petty Officer 2nd Class United States Navy, who led the audience in the Pledge of Allegiance and then detailed his career with the Navy serving mostly on the combat stores ship USS Mars.  Mr. Rozier worked as a crane operator and recounted several stories of the dangers involved in resupplying ships at sea due to both weather and combat conditions.  Through his service he learned the true meaning of the words opportunity, freedom and protection.  Mr. Rozier was born in Twiggs County and now calls Houston County home.  

 

Motion by Mr. McMichael, second by Mr. Walker and carried unanimously to approve the minutes of June 19 and June 26, 2012.

 

Motion by Mr. Thomson, second by Ms. Robinson to add item 2A for emergency purchase of a vehicle for the Sheriffs Department to the agenda.

 

Motion by Mr. Thomson, second by Mr. McMichael and carried unanimously to concur with a City of Perry annexation request for all that tract or parcel of land situate, lying and being in Land Lot 190 of the 13th Land District of Houston County, Georgia, being a tract of 1.52 acres which is more particularly shown on a plat of survey prepared by Milton Beckham, Surveyor, dated May 31, 1965 and being of record in Map Book 10, Page 75, Clerks  Office, Houston County Superior Court.  Proposed zoning for this property within the City of Perry is R-1, Single Family Residential District for a single family dwelling.  Property is located at 2001 Main Street, Perry, Georgia.

 

Motion by Mr. Thomson, second by Mr. Walker and carried unanimously to appoint Mr. Ron Grace to fill Mr. Albert Harrells unexpired term on the Houston County Board of Tax Assessors.  Mr. Graces term will expire December 31, 2013.

 

Motion by Mr. Thomson, second by Ms. Robinson and carried unanimously to approve the emergency purchase of a used fully-equipped 2010 Chevrolet Police Package (K-9) Tahoe, VIN# 1GNMCAE02AR110477, from Dooly County in the amount of $22,500.  Sheriff Talton will reimburse the County for the entire amount of the purchase from Drug Funds.  The Comptroller is authorized to issue a check to Dooly County, Georgia for $22,500.

 

Mr. Barry Holland, Director of Administration, presented a first reading of an Alcohol License Application submitted by Jindrakumar N. Patel representing MAA Durga, LLC D/B/A Dev Liquor Store for a retail sale of beer/wine/liquor located at 2328 Hwy. 41 N., Perry, Georgia.  The property is zoned C-2.  A second reading and public hearing will be held at 6:00 p.m. on July 17, 2012 in Warner Robins after which the Commissioners will vote on the issue. 

 

Motion by Mr. Walker, second by Mr. McMichael and carried unanimously to appoint Mr. Chris Murman to fill Ms. Nancy Newells unexpired term on the Houston County Planning and Zoning Board.  Mr. Murmans term will expire September 6, 2015.

 

Chief Building Inspector Tim Andrews presented Special Exception Application #1655 submitted by Ms. Glenda Wynette Collins.  The property is located at 122 Sparrow Street, Perry, Georgia, and is more specifically described as LL 109, Lot 9  Block B, Section 2, of Birdsong Acres Subdivision in the 10th Land District, of Houston County, consisting of 1 (one) acre. Existing use is residential, R-AG zoning. Proposed use is a Special Exception for a Home Occupation for a Home Daycare Business with no change in zoning.  The Zoning and Appeals Board recommends approval of Application #1655. 

 

Chairman Stalnaker then opened a public hearing on Special Exception Application #1655.

 

Mr. Thomson inquired if the applicant had a fence around her swimming pool.  The applicant stated that she has a fence around her pool and that she would be erecting an additional fence between her property and her neighbor.

 

Ms. Collins, proponent, stated she must have County approval before State will approve her license.  She also indicated that her playground is double-fenced.

 

Ms. Stacey Campbell of 321 Lovorn Circle, Warner Robins, Georgia spoke in favor of the application.

 

Ms. Joy Dumas of 225 Noah Lane, Perry, Georgia also spoke in favor of the application.

 

There was no opposition.

 

There being no further public comments, the hearing was closed.

 

Motion by Mr. Walker, second by Mr. Thomson and carried unanimously to approve Application #1655. 

 

Tim Andrews, Chief Building Inspector, presented Special Exception Application #1656 submitted by Jonathon Burch.  The property is located at 1936 S. Houston Lake Road, Kathleen, Georgia and is more specifically described as LL 183, 10th Land District of Houston County, Lot 5A, Block B of Dennard-Hammock Subdivision, consisting of 1.82 acres.  Existing use is residential, R-AG zoning.  Proposed use is a Special Exception for a Home Occupation for a Lawn Care Business with no change in zoning.  The Zoning and Appeals Board unanimously recommends approval of Application #1656, subject to initially allowing a 5 x 8 (five by eight) foot trailer and later replaced by a 7 x 14 (seven by fourteen) foot covered trailer to be stored in the rear yard of the property.

 

Chairman Stalnaker then opened a public hearing on Special Exceptional Application #1656.

 

Mr. Walker inquired as to when the larger enclosed trailer would be purchased.  Applicant was unsure at this time.

 

Mr. Jonathon Burch, proponent, stated that most of the lawn care would be for residential customers with a few commercial accounts as well.  Mr. Burch stated he works full-time at Robins Air Force Base and the lawn care business will be part-time work.

 

There was no opposition.

 

There being no further comments, the hearing was closed.

 

Motion by Mr. Walker, second by Ms. Robinson and carried unanimously to approve Application #1656 subject to initially allowing a 5 x 8 (five by eight) foot trailer and later replaced by a 7 x 14 (seven by fourteen) foot covered trailer to be stored in the rear yard of the property. 

 

Tim Andrews, Chief Building Inspector, presented Special Exception Application #1657 submitted by Traci Bass.  The property is located at 429 Langston Road, Perry, Georgia and is more specifically described as LL 86, of the 10th Land District of Houston County, Georgia on a Plat of Survey for Julian B. Stevens & Mary S. Stevens, consisting of 2.02 acres.  Existing use is residential, R-AG zoning.  Proposed use is a Special Exception for a Home Occupation for a Bookkeeping Business with no change in zoning.  The Zoning Appeals Board unanimously recommends approval of Application #1657.

 

Chairman Stalnaker then opened a public hearing on Special Exceptional Application #1657.

 

Mr. Walker inquired as to whether clientele would be coming to the residence.  Applicant stated that no clientele would be coming to the residence since she would meet with clients at their place of business.

 

Ms. Bass, proponent, stated that she would be providing bookkeeping services for businesses.

 

There was no opposition.

 

There being no further comments, the hearing was closed.

 

Motion by Mr. Walker, second by Ms. Robinson and carried unanimously to approve Application #1657.

 

Tim Andrews, Chief Building Inspector, presented Special Exception Application #1658 submitted by Ms. Caroline Nwanegbo Williams.  The property is located at 210-A Virginia Dare Drive, Warner Robins, Georgia and is more specifically described as LL 222, of the 5th Land District of Houston County, Lynmar Subdivision, Lot 86,, consisting of .37 acres.  Existing use is residential, R-4 zoning.  Proposed use is a Special Exception for a Home Occupation Mobile Ice Cream Vending Business with no change in zoning.  The Zoning Appeals Board unanimously recommends approval of Application #1658.

 

Chairman Stalnaker then opened a public hearing on Special Exceptional Application #1658.

 

Mr. Thomson inquired as to whether the applicant needed a license through the Health Department.  Mr. Andrews stated that it was not necessary since all of her ice cream would be pre-packaged.

 

Ms. Williams, proponent, stated that she is a single mother and a student who would like to sell the ice cream and sodas to support her family.

 

Mr. Walker inquired as to where her product would be purchased.  Applicant stated she picks up most of her product at the Blue Belle in Byron with very infrequent deliveries to her home.

 

There was no opposition.

 

There being no further comments, the hearing was closed.

 

Motion by Mr. Walker, second by Mr. McMichael and carried unanimously to approve application #1658.

 

Motion by Mr. Walker, second by Mr. Thomson and carried unanimously to approve the temporary hire of Mr. Ryan English at pay grade 18-A, $15.95/hour to fill-in during the absence of Mr. Matt Drury who will be fulfilling an Army Reserve obligation beginning July 8, 2012 through late November 2012.  Mr. English employ will begin on July 30, 2012 and terminate on November 21, 2012.  Mr. English will receive no benefits with this temporary placement.

 

Motion by Ms. Robinson, second by Mr. Thomson and carried unanimously to approve the hiring of  poll workers for the upcoming July 31, 2012 General Primary/Nonpartisan General/Special Election not to exceed $26,379.00.

Motion by Mr. McMichael, second by Mr. Thomson and carried unanimously to approve a bid for filters for warehouse inventory covering the base period from July 1, 2012 through June 30, 2013, plus two one year renewal options covering July 1, 2013 through June 30, 2014, and July 1, 2014 through June 30, 2015, to TruckPro of Macon, Georgia.  Filters will be ordered on an as needed basis.

 

Motion by Mr. McMichael, second by Ms. Robinson and carried unanimously to ratify the emergency purchase of a 2012 Ford F-150 from Five Star Ford of Warner Robins in the amount of $17,625.72.  The truck will be for use in the Water Department.

 

Motion by Mr. McMichael, second by Mr. Thomson and carried unanimously to terminate the contract with Diversified Industries of Albany, Georgia for non-performance, and to approve the bid for right-of-way maintenance along portions of SR127, Sandefur Road and Lake Joy Road to All Seasons Lawn Care, Inc. of Macon, Georgia in the amount of $11,210 per month.  Motion is contingent upon the City of Perry signing a revised Inter-governmental agreement with the County reflecting the change in contractor and bid price.

 

Motion by Mr. McMichael, second by Ms. Robinson and carried unanimously to approve the payment of bills totaling $1,809,594.28.

 

Chairman Stalnaker then opened the meeting for public comments. 

 

Mr. Walton Wood commended Public Works employees for the fast response and repair on a water leak on Sandefur Road that he reported Monday evening.

 

Chairman Stalnaker recognized District Attorney George Hartwig, Mr. Charlie Holt who recently retired from the Houston County Detention facility, Mr. Newton and Ms. Wood representing the Library Board.  Mr. Newton briefed the Board on the Nola Brantley Library renovation and addition.  He stated that the RFQ is out for the contractor and the design process is well under way.  He also stated that although the library will have to shut down for approximately nine months during the process it would be located nearby in a temporary building.  The Chairman remarked that the Perry branch of the library would be receiving SPLOST funds for a future renovation as well.

 

Chairman Stalnaker briefed the Board and audience of the July 17th appointment of the new Commander at Robins Air Force Base, Cedric George.  The change of command ceremony will be held at the Museum of Aviation at 10:00 a.m. 

 

Chairman Stalnaker asked Chief Williams whether there were restrictions on citizens using fireworks during this dry season.  Chief Williams stated that the only restrictions were that they could not use any fireworks that shot into the air since they were not legal in Georgia without proper licensing.

 

Mr. Walker wished everyone a happy and safe July 4th.  He also recognized Assistant District Attorney Jacob Poole.

Mr. Thomson wished everyone a happy and safe July 4th and asked Chief Williams how the celebration (concert and fireworks show) was for the emergency personnel.  Chief Williams reported no real problems resulted from the celebration.

 

Mr. McMichael reminded everyone to remember the reason for the 4th of July holiday.
